1. Overview and Acceptance of Terms

These Terms & Conditions ("Terms") govern your access to and use of the FeedbackCert platform ("we," "us," or "our"), a SaaS credentialing and analytics infrastructure available at feedbackcert.com. By registering an account or executing a transaction, you agree to these Terms, our Privacy Policy, and our Refund Policy. If you are registering on behalf of an organization, you warrant that you possess the legal authority to bind that entity to these Terms.

02Description of Service

FeedbackCert provides software tools that allow organizations to collect survey responses and automatically generate, deliver, and verify digital certificates. We provide the infrastructure; we are not an accrediting body, educational institution, or regulatory authority.

03Account Registration and Security

You must be at least 18 years of age (or the minimum legal age of digital consent in your jurisdiction) to initiate a subscription. You are wholly responsible for maintaining the confidentiality of your login credentials. You agree to assume all liability for any activities, data imports, or certificate generation that occurs under your account. You must immediately notify us at support@feedbackcert.com of any unauthorized access.

04Acceptable Use and Anti-Abuse Policy

We maintain a zero-tolerance policy for credential fraud and network abuse. You explicitly agree not to:

  • Issue certificates that falsely represent academic degrees, government qualifications, or professional licensing without possessing the explicit legal authority to do so.
  • Upload purchased participant lists, distribute spam, or use the automated email delivery system for unsolicited communications.
  • Interfere with the platform's verification architecture or attempt to manipulate analytics data.
  • Process sensitive personal data (e.g., medical data, financial data) of your participants through our feedback forms.

FeedbackCert reserves the absolute right to suspend or terminate accounts—without notice or refund—that engage in fraudulent, deceptive, or abusive practices.

05Subscriptions, Payments, and Billing

Our order process is conducted by our online reseller, Paddle.com. Paddle.com is the authorized Merchant of Record for all orders, handling payment processing, billing compliance, and applicable global taxation (VAT/GST).

  • Auto-Renewal: Your subscription will automatically renew at the end of your indicated billing cycle (monthly or annually) to ensure uninterrupted service.
  • Cancellations: You may cancel your subscription at any time via your account settings. Cancellations prevent the next renewal charge but do not trigger pro-rata refunds for the current cycle.

06Intellectual Property

  • Platform Assets: FeedbackCert retains exclusive rights, title, and interest to the platform's underlying code, interface, analytics algorithms, and provided design templates.
  • User Content: You retain full ownership of the data, logos, text, and specific certificate designs you configure within the platform. By utilizing the Service, you grant FeedbackCert a limited, secure license strictly to process, translate, and transmit this data for the purpose of executing your automated workflows.

07Limitation of Liability

To the maximum extent permitted by applicable law, FeedbackCert is provided on an "AS-IS" and "AS-AVAILABLE" basis without warranties of any kind. We explicitly disclaim liability for any indirect, incidental, punitive, or consequential damages (including loss of data, revenue, or organizational reputation) arising from platform downtime, unauthorized credential issuance by users, or email deliverability failures. Under no circumstances shall our total aggregate liability exceed the total subscription fees paid by you in the twelve (12) months immediately preceding the event giving rise to the claim.

08Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Pakistan, excluding its conflict of law principles. Any irreconcilable dispute arising from these Terms shall be resolved via binding arbitration in Lahore, Pakistan. To the fullest extent permitted by law, you agree to waive any rights to participate in a class-action lawsuit against FeedbackCert.
